TERMS & CONDITIONS – CARBON CAR RENTAL

1. Company details
Carbon Car, S.L. (CIF B09856378) is a car rental company based at Vía Hotel Guadalpín, 2P, 29604 Marbella (Málaga), Spain. Phone: +34 661 81 73 33. Email: carboncarrent@gmail.com.

2. Driver requirements
To rent a vehicle with Carbon Car:
– The main driver and any additional authorised drivers must be at least 25 years old.
– Each driver must have held a valid driving licence for at least 7 years.
– Only the renter and drivers explicitly authorised in the rental contract may drive the vehicle.

Carbon Car reserves the right to refuse the rental or terminate the contract if these conditions are not met.

3. Vehicle use
The vehicle must be used responsibly and in accordance with Spanish traffic regulations. It may not be used for:
– Commercial or industrial transport
– Paid passenger services (taxi, VTC, etc.)
– Races, competitions or off‑road driving
– Towing other vehicles
– Any illegal activity or use contrary to the rental contract

The authorised use area is Spain. Leaving Spain without prior written authorisation from Carbon Car is strictly forbidden.

4. Deposit and insurance
A security deposit is required for each rental. The exact amount depends on the vehicle category and rental period and is specified in the rental contract.

The deposit is used to cover:
– Damage to the vehicle
– Misuse or lack of fuel
– Unpaid charges (for example, fines, tolls or extra services)

If the value of the damage or unpaid charges is lower than the deposit, the remaining amount will be returned to the renter. If it is higher, Carbon Car may keep the full deposit but will not claim any additional amount from the renter.

All vehicles include insurance with an excess (franchise). The amount of the excess is stated in the rental contract.

5. Fuel and mileage
Unless otherwise stated:
– The vehicle is delivered with a full tank and must be returned with a full tank (full‑to‑full policy).
– Included mileage is unlimited. Any price for extra kilometres, if applicable, is specified in the rental contract.
– Fuel or refuelling services are charged according to the current price list.

6. Smoking, pets and cleaning
Smoking inside the vehicle is prohibited. Excessive dirt caused by pets, sand, liquids or similar misuse may result in an additional cleaning charge. If the vehicle is returned with a smell of tobacco, pet hair, sand or similar dirt, €200 will be deducted from the deposit as a cleaning fee.

7. Late return
The vehicle must be returned on the date, time and at the place agreed in the rental contract.

– If the renter expects to be late, they must inform Carbon Car before the return time. Depending on the delay and vehicle availability, an extra part of a day or an extra rental day may be charged.
– If the renter does not inform Carbon Car, returns the vehicle late without justification or does not answer calls/messages, Carbon Car may charge up to two daily rental rates (double daily rate), plus any additional costs caused by the delay.

8. Fines, tolls and road charges
The renter is responsible for all fines, penalties, tolls, parking tickets and other road charges incurred during the rental period.

For each fine or road charge processed by Carbon Car, a management fee of 10 € will be charged in addition to the amount of the fine or charge.

9. Bookings, cancellations and no‑show
At the time of booking, a reservation amount of 100 € (or another amount agreed in writing) may be required.

– If the renter cancels at least 14 days before the agreed start date of the rental, the reservation amount will be refunded.
– If the renter cancels less than 14 days before the start date or does not show up to collect the vehicle, the reservation amount is non‑refundable, unless Carbon Car expressly decides otherwise in writing.

10. Early return
If the renter returns the vehicle before the end of the agreed rental period, Carbon Car is not obliged to refund unused days, unless otherwise agreed in writing.

11. Personal data
The renter’s personal data are processed by Carbon Car to manage the rental contract and comply with legal obligations. The renter may exercise their data protection rights by writing to carboncarrent@gmail.com.

12. Applicable law and jurisdiction
These terms and any rental contract with Carbon Car are governed by Spanish law. Any dispute will be submitted to the courts of Spain.
